Terms and Conditions of Booking & Hire
Introduction.
This document is issued by MC Prestige Events, to describe the terms and conditions of hire of the company’s equipment for Boxing events, sporting events, wedding’s, parties and other co-operate events. This document is the Terms & Conditions also known as the T&Cs of Hire in full, laying down the contractual agreement between MC Prestige Events and the hiring party.
Overview:
By accessing this website, you warrant and represent to the website owner that you are legally entitled to do so and to make use of information made available via the website.
- You declare you are over the age of 18.
- You must read and understand the following Terms & Conditions and by placing a booking, you agree to adhere to them.
- A security/booking deposit must be paid in full via bank transfer, credit or debit card to the details provided to you on your sales invoice.
Payment & Deposit:
A non-refundable booking fee is required at the time of booking to secure your event date. Bookings made less than 21 business working days prior to your event start date is required to pay the full hire fee.
- Full or final payment(s) must be made 14 working days prior to the event start date stated on your agreement/invoice.
- Cancellations, please note our cancellation policy below before making a booking with us.
- Your deposit or initial first payment becomes non-refundable up on receipt and will be used to secure your booking.
Corporate credit cards are accepted subject to merchant fees.
General Terms and Provisions:
- Contract of Hire: The placing of an order for an event by the hirer or the issuing of a sales invoice by MC Prestige Events constitutes a contract that binds the hirer to accept these conditions.
1.1 Termination: MC Prestige Events may terminate the hire contract if the hirer fails to meet any of these terms and conditions:
Cancellation Terms.
Cancellation of 90+ days from your event date, will result in a 20% charge from your total balance.
Cancellation of 30 days to 89 days from your event date will result in a 40% charge from your total balance.
Cancellation of 14 days to 29 days from your event date will result in a 50% charge from your total balance.
Cancellation of 7 days to 13 days from your event date will result in a 75% charge from your total balance.
Cancellation within one week of your event date will result in a 80% charge from your total balance.
Definition of expressions used:
“Hire” – This expression refers to the arrangement to use equipment supplied by the Company at an event. The period of Hire under these terms is usually one or more days and rates applied may be quoted as ‘the Hire Cost’ or ‘the Daily Rate’, or ‘the Weekly Rate.’
“Hirer” – The person, company, department or other body who has ordered and/or accepted goods or services from Pro Audio Visual.
“The Equipment” – All items of equipment and or services accepted by the hirer along with any other items and or services included or implied whether specified or not.
“Owner/The Company” – MC Prestige Events Ltd
Provision of the Equipment:
- MC Prestige Events agrees to supply you with the equipment, sound, lighting, rigging or equipment described in the hire agreement or invoice for the hire period.
- All equipment is supplied in full working order and any defective or incorrect items will be replaced promptly by MC Prestige Events.
- Equipment will always remain the property of MC Prestige Events for entirety. In the event of a breach of any of these conditions, MC Prestige Events may terminate the arrangement and repossess all their Equipment under certain circumstances.
Responsibilities of the Hirer:
- The hirer assumes full security responsibility for the equipment during the time of arrival and time of departure. The hirer must have adequate insurance cover including their own public liability, and insurance that covers theft/damage of the equipment. The hirer is responsible for the safekeeping of the equipment and is liable for any loss or damage caused to the equipment during the period of the event hire or during the time on site. This covers from time of arrival to time of departure as previously mentioned. The hirer is responsible for providing suitable and adequate security arrangements for the safekeeping of the equipment during the period of hire. The hirer must take all necessary steps (at its own expense) to retain possession, and control of the equipment. In the event of losing possession or control, you are to take all necessary steps to recover or replace the equipment. If this is not facilitated, the hirer will result in a raised bill covering the full amount of any equipment damaged, lost or stolen while on site.
5.1. Equipment is not to be modified in anyway.
5.2. Any discrepancies with the order must be brought to the attention of MC Prestige Events immediately upon arrival or setup.
- The cost of replacing or repairing damaged equipment will be paid in full by the hirer. Equipment lost, damaged, stolen or modified will be charged at the full rate of replacement.
6.1. Examples of loss, damaged, stolen or modification include but are not limited to the following:
- Damage caused by persons known or unknown, including audiences and artists
- Damage or loss caused by inadequate handling by third parties hired by or used by the hirer including but not limited to local crew
- Damage by adverse weather conditions including but not limited to water damage
- Loss due to theft while on site
- Loss or damage during transportation is on site
- Modifying cables by cutting and/or re-wiring plugs/sockets
- Modifying of any equipment at the hands of a third party other than those who work for MC Prestige Events
- Sound Pressure Levels: High sound pressure levels can cause permanent hearing damage. Repeated exposure can have a cumulative effect. Certain pieces of equipment provided by MC Prestige Events can and does produce high enough sound pressure levels to cause permanent hearing damage. MC Prestige Events cannot & does not accept any liability for any individual’s failure to stay at an appropriate distance from loudspeakers or failure to take any necessary steps to protect their own hearing. It is the responsibility of the hirer to ensure that the correct safety measures are in place regarding hearing of the public, spectators or participants. This recommended minimum distance will be giving when on site upon seeing the venue layout. Where appropriate you may wish to ensure that warning notices are displayed, hearing protection is issued, or safety barriers are erected at a safety distance recommended by their own safety advisor.
- Event Licencing. The hirer is solely responsible for obtaining any license required to operate the event where MC Prestige Events equipment is being used. Should MC Prestige Events discover an event does not have the necessary licensing, or authority to hold the event, we hold the right to stop the event & equipment will be removed immediately off-site, and all hire fees will be lost.
- Hire Location. The hirer is responsible for providing a suitable venue including buildings and grounds, they are to ensure the ground is flat & where possible waterproof to save damage to equipment.
Hire Periods, Charges and Payments:
- When equipment is being delivered to a site and setup by MC Prestige Events, the hirer must provide suitable parking for unloading and loading of equipment, arrangements are to be in place for storing the vehicle whilst the event is taking place. If no parking is provided, MC Prestige Events may charge a fee to cover suitable parking close to the venue. If the loading bay is more than 25m away from the venue loading door and/or has steps, the hirer will need to notify MC Prestige Events of this as it may require extra staff to move equipment which may incur extra charges if not pre advised. Setup time depends on the size of your event and can be discussed prior to your booking; we require a minimum of 4 hours to collapse and store our equipment away safely and securely. This time is an estimate and should be factored when hiring a venue.
Hirer:
- If the hirer fails to pay any sum(s) payable under these conditions in full within 14 working days of your event date, such sums becoming due (whether demanded or not)
11.1. Commits a breach of any of the other terms and conditions of the contract (whether express or implied)
11.2. Is involved in any legal process (whether directly or indirectly) that results in a levy on or against any of the hired equipment, or against any premises where the equipment is, or against any of the hirer’s goods or other property, or the hirer permits any judgement against it to remain unsatisfied for seven days.
11.3. Suffers an interim order (as an individual) under the Insolvency Act or enters a voluntary arrangement or suffers the making of a statutory demand or the presentation of a petition for a bankruptcy order.
11.4. Enters into any liquidation, calls any meeting of its creditors, or has a receiver or administrative receiver appointed of all or any of its undertaking or assets, or suffers the appointment or the presentation of a petition for the appointment of an Administrator under the provisions of Part II of the Insolvency Act, or is deemed by virtue of Section 123 of the Insolvency Act to be unable to pay its debts.
- Force Majeure: MC Prestige Events is not liable for any failure to supply a product or service where that failure is caused by an event that could not reasonably have been foreseen, forestalled or prevented. This may include, but is not limited to, a Pandemic, acts of war, terrorism, natural disasters, acts of God, guidance by the World Health Organization or the United Kingdom Government, or any other health agency whether it be worldwide, nationally or locally. For international events MC Prestige Events will not accept liability for any delays in our equipment entering or exiting the UK, if delays occur by strikes, protests or other natures that are subject to delaying our services to you, a date change or credit note will be made available, or a refund can be giving but are subject to administrative fee’s including but not limited to, transportation costs, accommodation costs, labour & wages, travel expenses. If an event is cancelled or postponed by the event organizer a credit note will be issued.
- English Jurisdiction: All agreements, contracts and transactions entered with MC Prestige Events will be bound and governed by English Law. This document coincides with any other terms and conditions of hire that may have been signed.
14 Equipment Care.
14.1 Sound, lighting, video and other DJ equipment including any rigging must be checked by a member of the MC Prestige Events crew prior to the event starting.
14.2 Additional barriers are required to protect the main console area via the DJ box to protect all staging equipment.
- Liability.
15.1 The hirer shall arrange with the venue to supply adequate 24-hour security for the protection of equipment for overnight events to prevent theft, loss, tampering and/or damage to equipment on the hirer’s premises overnight.
15.2 Compensation will be paid in full by the hirer for any damaged, loss or stolen items. MC Prestige Events will bill the hirer at full market cost of any individual item(s) that has been damaged, lost or stolen whilst on their premises.
15.3 The hirer accepts these liability claims in section 15. They also accept the liability for any damages, loss of any future expense(s) that MC Prestige Events may suffer. This may include but is not limited to any future bookings that have been made that can no longer be fulfilled. The hirer may be held accountable for any additional hire equipment allocated to future events until any items are replaced. This includes but is not limited to items that have been lost, damaged or stolen during their event.
- Trademarks.
16.1 Trademarks, names, logos and service marks (collectively “trademarks”) displayed on this website are registered and unregistered trademarks of the website owner. Nothing contained on this website should be construed as granting and license or right to use any trademark without prior permission written permission of the website owner, and should be requested by using the following email address: info@mcprestigeevents.com.
- External links.
17.1 External links maybe provided for your convenience; however, they remain beyond the control of the website owner and no representation is made as to their content. Use or reliance on any external links provided is at your own risk.
- Additional Charges. This may include but is not limited to, Vehicle charges, Accommodation charges, power supply charges, Labour charges and others that may not be listed here but will be seen within your Invoice. Charges are separate to any package deals & are classed as additional charges. Package deals consist of the hire of the equipment only for your event, unless stated otherwise.
- Pre-Contract
19.1 A pre-contract will be sent on agreement of the event. This contract is legally binding and is a contract between both parties meaning that, MC Prestige Events agrees to provide a service on the date stated & agreed within the invoice sent to the hirer. The hirer agrees all terms and conditions both within the pre-contract and also on our website in which they promises to adhere to them.
19.2 Failing to sign and return our pre-contract agreement but instead placing a deposit to secure your event will be taken that you have read and understood all our terms and conditions and that you have agreed to adhere to them, failure to adhere to the terms and conditions may result in all fee’s paid lost resulting in the loss of your event.
